Terms and Conditions

These terms and conditions of service (“Terms & Conditions”) govern your use of the Fissix Fix-It LLC DBA Reviving Your Ride platform or website (the “Platform”). Compliance with these rules is a condition to your use of the Platform. BY USING THE PLATFORM, YOU ARE INDICATING THAT YOU ACCEPT, AND AGREE TO COMPLY WITH THIS AGREEMENT. IF YOU DO NOT ACCEPT THIS AGREEMENT, YOU MUST NOT ACCESS, MAKE ANY PURCHASE, OR OTHERWISE USE THIS SITE, OR PLATFORM. Please also consult our Privacy Policy for a description of our privacy practices and policies.

SCHEDULING A JOB

To request an appointment for Automotive Repair Service (a “Repair Request”), you may be asked to specify the type of service that you think is required, the location where you would like the Repair Request to be performed, and the date and time that you would like the Repair Request to take place. You agree that it is your responsibility to provide a suitable location for the Repair Request, and to ensure that the Mobile Mechanic has proper access and permission, and is legally authorized to complete the Repair Request at the location.

Once you submit a Repair Request, we will provide you with a quotation. We reserve the right to modify, add, or delete items and/or price at any time prior to billing you. If you have agreed with the Mobile Mechanic to modify, add, or delete items in the Repair Request, or to reschedule a Repair Request, it must be notated on the invoice and signed by you.

Customers are provided the ability to cancel their requests up until the mechanic has called them to inform them the mechanic is en-route without any fees being incurred. You may also call or email us using the contact information below to cancel or reschedule a Repair Request.

You agree to treat Mobile Mechanics courteously and lawfully, to provide a safe and appropriate working environment that is in compliance with all applicable laws and regulations, and to provide reasonable cooperation to enable Mobile Mechanic to complete the Repair Request. You acknowledge that our Mobile Mechanic may be unavailable from time to time, e.g. due to illness, or vacation.

Plastic, composite and rubber engine and cooling system components are often affected by age and temperature fluctuations and become fragile over time. Reviving Your Ride handles these parts with care and caution but because the nature of these parts they can break or even disintegrate during procedures that involve their disassembly or handling. You understand that we will not be held liable for these types of component failures, and that in the event of such, Reviving Your Ride will provide you with a revised estimate to include the replacement of the failed component.

If you would like to receive the replaced vehicle parts upon completion of the Repair Request, please tell the Mobile Mechanic on site and, if applicable, you will be charged the core price for the replacement part and you will be responsible for proper disposal of such parts in accordance with all applicable laws, regulations and rules. Some parts come with a manufacturer’s warranty. In the event you make a claim using such warranty through Reviving Your Ride, those parts must be returned to us.

PAYMENT TERMS

You understand that use of the Services may result in charges to you. Charges may include any applicable federal, state and local taxes. Payment is due prior to the Service via cash or credit/debit card. We accept Visa, Mastercard, American Express, Discover, and ACH payments through our online invoicing or Point of Sales system, Helcim. While we make every reasonable effort to ensure the security of all credit card and all other personal information, we expressly disclaim any liability for any damage that may result should any information be released to any third parties, and you agree to hold us harmless for any damages that may result therefrom. Charges paid by you are final and non-refundable, unless otherwise determined by us. All Charges are due immediately.

We reserve the right to establish, remove and/or revise Charges for any or all Vehicle Services at any time in our sole discretion. You must authorize any changes to the Vehicle Services needed or additional Vehicle Services if the mechanic deems them necessary. If the mechanic determines that your car requires services other than the Vehicle Services you specified in your original Job Request, you may be charged a separate diagnosis fee.

DISCLAIMER

By approving the charges for the repair request you authorize the automotive repair services as written in the quotation to be done along with any necessary material, and agree that you may not hold Reviving Your Ride liable for any theft, loss of articles, damage caused whether it be directly or indirectly related to the automotive repair work performed, nor may you hold us liable for any delays due to weather, force majeure, logistics, supply chain or transportation.

As the authorized approver, you grant Reviving Your Ride mechanics permission to operate the vehicle, as presented in the quotation, on streets, highways or elsewhere for the purpose of testing and/or inspection. A mechanic’s lien is hereby acknowledged on the vehicle being repaired to secure the amount of repairs thereto in accordance with Virginia laws.

You understand that you have the right to know, before authorizing any automotive repair services, what the repairs to the car will be and the associated costs. Reviving Your Ride will always obtain express approval by writing, text or other electronic form, prior to performing any automotive repair services. If the total amount for such repairs does exceed a previous authorized amount, you will be required to authorize those charges before resuming or finishing the outlined automotive repair services.

MISCELLANEOUS

Governing Law. This Agreement and the relationship between you and Fissix Fix-It LLC DBA Reviving Your Ride will be governed by the laws of the State of Virginia, without giving effect to any choice of laws principles that would require the application of the laws of a different country or state.

Dispute Resolution. Any claim or controversy between you and Reviving Your Ride arising out of, or relating to, this Agreement shall be finally decided by arbitration.  Subject to any valid requirements of any applicable statute, any such arbitration shall be held in Newport News, Virginia.  During the course of any arbitration hereunder, each party will bear its own costs and attorneys’ fees, and share equally the arbitrator’s fees and expenses, except that the arbitrator shall award to the prevailing party all reasonable attorneys’ fees resulting directly or indirectly from such arbitration.  The award rendered by the arbitrator shall be final, and judgment may be entered upon it at any court having jurisdiction.  The arbitrator shall have the authority to award temporary, preliminary and permanent injunctive and equitable relief in the arbitration.  Any arbitration hereunder will be confidential.

No Assignment. You may not assign your rights under this Agreement without our prior written consent, and any attempted assignment will be null and void.

Force Majeure. Any delay in the availability of the Service or the performance of any Job will not be considered a breach of this Agreement if such delay is caused by a fire, earthquake, flood, war, terrorist act, governmental act, failure of common carriers (including Internet service providers), act of God, or any other event beyond the control of Reviving Your Ride or the mechanic, provided that performance is resumed as soon as possible.

Severability. If any provision of this Agreement is held or determined to be invalid, unenforceable, or void, the remainder of this Agreement shall remain in full force and effect.

Entire Agreement; No Waiver. This Agreement constitutes the entire agreement between you and Fissix Fix-It regarding the use of the Service. Our failure to exercise or enforce any right or provision of the Agreement will not operate as a waiver of such right or provision.  The section titles in this Agreement are for convenience only and have no legal or contractual effect.

Use of Pictures. Reviving Your Ride takes photos of the vehicle booked for maintenance/repair for several reasons including, but not limited to internal training, documenting damage, and external marketing campaigns. Individual customer information such as residential address, customer name, facial likeness, license plate number/vehicle identification number will be protected.

Youtube: Reviving Your Ride maintains a YouTube.com creator account. Mechanics may record videos to be uploaded to their channel. We take the protection of your personal information seriously and will never publish any identifying information including licenses, license plates, addresses, etc. Prior to publishing any recording that may include you as a guest on our channel, you will be required to sign a release. You have the right to decline being recorded.

Notices. We may give notice to you by email or other reasonable means.
